About going to court
If you choose to go to court this means:
- the matter will be filed at the court
- you may need to appear before the court at a specified date and time (you will be notified of your court date, time, and location). This is called a hearing.
If you don't go to your hearing, the court can decide the matter without you being there.
The court will hear your case and decide on an appropriate penalty. They may decide to:
- issue you with a fine (the penalty could be more or less than the amount on your original Infringement Notice) and order you to pay costs, or
- dismiss or discharge your case, or
- adjourn (delay) the matter.
Conditions you must meet
You can request a court hearing for a safety camera infringement or traffic offence notice if you're:
- the person named on the notice, or
- a person they’ve given specific authority to act on their behalf, or
- an authorised representative of a company or incorporated body.

You must request a court hearing before the final due date on your reminder notice.
You can’t request a court hearing for any notice when the fee has already been paid.
If you request a court hearing and later change your mind and wish to pay it, you will need to contact us.
