Purpose

This note is to advise of interim updates to the Waka Kotahi NZ Transport Agency State Highway Construction Contract Proforma Manual (SM031). Updated documents have been released to be used for all future procurement and are available for download from the Waka Kotahi website.

The updates apply from the date of this notice.

General information

The State Highway Construction Contract Proforma Manual (SM031) is utilised by Waka Kotahi and external consultants when preparing state highway tender documents for traditional, design and construct, lump sum, alliancing and minor works and physical works construction contracts.

The processes and procedures outlined in this update must be followed by Waka Kotahi for all physical works construction contracts that are undertaken from now on.

Purpose of the change

In light of the change to the COVID-19 Protection Framework and further changes to reflect the spread of Omicron in New Zealand, Waka Kotahi has reviewed and updated the Communicable Disease clause in the SM031 Manual to reflect the current environment and to ensure Waka Kotahi continues to take a consistent approach with any future COVID-19 claims (and other similar events).

Specific changes

The changes to SM031 include:

• Appendix A – Traditional (A8, Conditions of Contract)
• Appendix B – Design & Construct (B4, Conditions of Contract)
• Appendix E – Minor Works (E1, Closed Contest; E2, Direct Appoint)
• Appendix H – Early Contractor Involvement (H3, Conditions of Contract)

Communication plan

Our target audience for this manual is generally internal staff and those external consultants who conduct procurement on behalf of Waka Kotahi. As a result, our communications will mostly be focussed internally. Advice of these changes will be promulgated by:

• this note advising the updates
• direct access via the external website and intranet
• guidance issued to Project Managers, Engineers to Contract and Owner Interface Managers
• delivery of presentations at the next Project Managers Forum.

Implementation

The SM031 Manual is published for use on the Waka Kotahi website and InfoHub and will be updated to reflect the changes.

Document review

A review of the effectiveness of the current SM031 Manual will occur in 2022.
