This note is to advise that a new Alliance contract model proforma has been released to be used for all future procurement where an Alliance model will be used. The updated Alliance contract model appears in Appendix D to issue 14 of the Waka Kotahi NZ Transport Agency State highway construction contract proforma manual (SM031) and Appendix B to issue 11 of the Waka Kotahi NZ Transport Agency State highway maintenance contract proforma manual (SM032).

For a copy of the new Alliance contract model, contact Procurement at Waka Kotahi at the address below. The changes are mainly internal process changes, all-of-Government and sector requirements and editorial changes. The new versions of Appendix D and Appendix B apply from the date of this notice.
Appendix D to the State highway construction contract proforma manual (SM031) and Appendix B to the State highway maintenance contract proforma manual (SM032) are used when forming a new Alliance for a construction or maintenance project.
Appendix D to SM031 and Appendix B to SM032 have been updated to reflect current business practice and to align with our Procurement Manual and the Procurement Policy. The processes and procedures outlined in this update to Appendix D to SM031 and Appendix B to SM032 must be followed by Waka Kotahi for all Alliance project procurements that are undertaken from now on.
Waka Kotahi is responsible for managing the state highway system, including planning, funding, design, supervision, construction, and maintenance and operations, having regard to the contribution to an effective, efficient, and safe land transport system in the public interest (Land Transport Management Act sections 2, 25 and 95).
The purpose of the Manuals is to fulfil the obligations of the Waka Kotahi to the Land Transport Management Act and also to provide organisations with some guidance in developing their own procedures. It also allows our contractors to be more aware of our expectations as an organisation.
The changes to Appendix D to SM031 and Appendix B of SM032 are not considered to have significant effects, consisting of:
All changes to Appendix D to SM031 and Appendix B of SM032 were made in consultation with selected internal and external subject matter experts.

Our target audience for Appendix D to SM031 and Appendix B of SM032 is Waka Kotahi staff and those external consultants who conduct procurement on behalf of Waka Kotahi. Advice of these changes will be promulgated by:
Appendix D to SM031 and Appendix B to SM032 are not currently published for use on the Waka Kotahi website and InfoHub. Users of Appendix D to SM031 and Appendix B to SM032 will be able to obtain copies of the updated Appendices, and a copy of the summary of amendments, by contacting Procurement at Waka Kotahi at the address below.
Given this update is reflective of current procedures and processes it was not considered necessary to conduct company-wide, specific training on the changes to Appendix D to SM031 or Appendix B to SM032.
A full review of the effectiveness of the changes and the current Manuals will be undertaken in June 2021.
