NZ Transport Agency Waka Kotahi (NZTA) is prosecuting KiwiRail in relation to an incident on 17 June 2023 in which the KiwiRail-operated Hamilton to Auckland Te Huia service failed to obey a red signal, risking a collision with another passenger train.
Two charges have been filed today in Manukau District Court.
One charge alleges that KiwiRail breached its key safety duty to ensure, so far as is reasonably practicable, that its rail activities were not likely to cause death or serious injury.
The second charge alleges that KiwiRail did not provide appropriate training and supervision of its personnel.
The first appearance hearing is scheduled for 2 July 2024 in Manukau District Court.
No further comment on the incident will be provided while the charges are before the Court.
