If the Director of Land Transport has revoked your licence, class or endorsement, and you disagree with the decision, you have the right to appeal to the District Court. 

This is under section 106 of the Land Transport Act 1998.

NZTA can't give you legal advice. We recommend you speak to a lawyer if you want to appeal a revocation. 

If you don't have access to legal advice, a Community Law Centre or Citizens Advice Bureau in your area may be able to provide independent advice.

How to appeal

The appeal process is explained in sections 106 and 111 of the Land Transport Act 1998, and subpart 2 of part 20 of the District Court Rules 2014.

You must send all your appeal documents to your nearest District Court. You must also email a copy of all the documents to NZTA at:

regulatory-appeals@nzta.govt.nz

You must send your documents to the District Court and to NZTA within 28 days of receiving the notice of revocation. If you take longer, you'll need to ask the Court's permission for an extension of time.

Affadavits

You must also produce an affidavit from you, and anyone else you want to provide information.

An affidavit is a legal document that explains your side of the case.

You need to include any documents and information you want the court and us to consider. Attach to the affidavit any documents you want to rely on that proves what you are saying.

You need to swear or affirm that your evidence is true and correct.

Revocation remains in place

Your revocation remains in place until the District Court makes its decision. 

You must not drive using a revoked licence, class or endorsement.
