On 19 June 2018, the State Services Commissioner appointed Doug Martin, together with Simon Mount QC, to undertake an Inquiry under the State Sector Act 1988 into the use of external security consultants by state sector agencies (the Inquiry). This included but was not limited to any use of Thompson and Clark Investigations Limited (TCIL) and its associated entities.
Mr Martin contacted the NZ Transport Agency on 23 July 2018 outlining the terms of reference for the Inquiry and inviting us to determine, through self-evaluation, whether any use of external security consultants by the Transport Agency were well managed with the appropriate oversight and controls in place. Mr Martin also asked we assure ourselves that any interaction or relationship with an external security consultant was consistent with the expectations of the public service as expressed in the Code of Conduct for the State Services.
To support the release of the State Services Commission (SSC) report into the use of external security consultants by public services agencies, the Transport Agency is proactively releasing the information provided to the SSC in the course of their investigation.
While the terms of reference for the investigation included the circumstances, reasons and outcomes of the engagement with or of external security consultants, it also held a specific focus on the relationship between organisations, TCIL and its associated companies and entities.
The Transport Agency has not engaged the services of TCIL.
