Objective of the Rule
Land Transport Rule: Traffic Control Devices Amendment 2016 (the amendment Rule) amends Land Transport Rule: Traffic Control Devices 2004 (the Traffic Control Devices Rule). The Traffic Control Devices Rule specifies the requirements for the design, construction, installation, operation, and maintenance of traffic control devices, and sets out the functions and responsibilities of road controlling authorities in providing traffic control devices to give effect to their decisions on the control of traffic.
The objectives of the amendment Rule are:
- - to allow the NZ Transport Agency, by notice in the Gazette, to make minor variations to the colour, shape, dimensions, words, letters, numerals, or symbols of traffic signs specified in Schedule 1:
- - to allow the NZ Transport Agency, by notice in the Gazette, to make minor variations to the colour, shape, dimensions, words, letters, numerals, or symbols of road markings specified in Schedule 2:
- - to allow the use of blue flashing reflective pavement markers as ice-warning markers:
- - to remove the requirement for flashing red signals (such as those at railway level crossings) to have a supplementary signal display:
- - to add new warning signs into Schedule 1:
- - to add the road markings for ‘sharrows’ into Schedule 2:
- - to replace the special vehicle display signal diagrams shown in Schedule 3.
Extent of consultation
For the purposes of consultation, amendments proposed to the Traffic Control Devices Rule and 14 other Land Transport Rules were combined into a single Rule, Land Transport Rule: Omnibus Amendment 2016 (the Omnibus Amendment Rule). Following consultation, the provisions in the Omnibus Amendment Rule were split into separate amendment Rules.
The NZ Transport Agency sent details of the amendment proposals by letter or email to approximately 3170 groups and individuals who had registered an interest in the Rules to be amended. The Omnibus Amendment Rule was made available through the NZ Transport Agency’s Contact Centre and, together with Questions and Answers, was also available on the NZ Transport Agency’s website. The availability of the amendment proposals for comment was publicised in the daily newspapers in Auckland, Hamilton, Wellington, Christchurch and Dunedin and in the New Zealand Gazette.
The NZ Transport Agency received 35 submissions on the Omnibus Amendment Rule, of which 19 commented on the proposed amendments to the Traffic Control Devices Rule.
The submissions received were taken into account in finalising the draft Rule following which it was submitted to the Associate Minister of Transport for signing.
Section 1 Application
1.1 Title
This Rule is Land Transport Rule: Traffic Control Devices Amendment 2016.
1.2 Commencement
This Rule comes into force on 1 December 2016.
1.3 Principal Rule amended
This Rule amends Land Transport Rule: Traffic Control Devices 2004.
Section 2 Amendments to Rule requirements
2.1 Amendment to clause 4.4
In clause 4.4(4),—
- (a) replace “4.4(1) and 4.4(3)” with “4.4(1), 4.4(2), and 4.4(3)”.
- (b) replace “does not comply with this rule” with “does not comply with the colour, shape, dimensions, words, numerals, symbols, number of elements, background, border, or legend specified in Schedule 1”.
2.2 Amendments to clause 5.4
2.2(1) After clause 5.4(1), insert:
- 5.4(1A) Despite 5.4(1) and 5.4(2), the Agency may, by notice in the Gazette, authorise the installation and maintenance of a marking that does not comply with the colour, shape, dimensions, letters, words, numerals, or symbols specified in Schedule 2.
2.2(2) In clause 5.4(6), delete “raised”:
2.2(3) Replace clause 5.4(6)(a) with:
- (a) blue and is installed on, or just to the left of, the centre-line of the roadway and is—
- (i) a non-flashing pavement marker used only to mark the presence of a fire hydrant or other water source used for firefighting; or
- (ii) a flashing, illuminated pavement marker used to indicate that the road may be slippery due to frost, ice, or snow; or
2.3 Amendment to clause 6.2
In clause 6.2(1A)(c), after “temporary traffic signals” insert “and flashing red traffic signals”.
2.4 Amendment to Schedule 1
In Schedule 1, Signs, after item W14-10.1, insert the three items set out in Schedule 1 to this Rule.
2.5 Amendments to Schedule 2
In Schedule 2, Markings, after M2-3A, insert the item set out in Schedule 2 to this Rule.
2.6 Amendment to Schedule 3
In Schedule 3, Traffic Signals, S4-10 Special Vehicle Displays, replace diagrams S4-10.1, S4-10.2, and S4-10.3 with the diagrams set out in Schedule 3 to this Rule.
