Objective of the Rule
Land Transport Rule: Traffic Control Devices Amendment 2007 amends Land Transport Rule: Traffic Control Devices 2004 (the Rule), which specifies the requirements for the design, construction, installation, operation and maintenance of traffic control devices, and sets out the functions and responsibilities of road controlling authorities in providing traffic control devices.
The objective of this amendment Rule is:
- to correct an error in the size specified for the crossing indicator sign known as a ‘belisha beacon disc’ and to ensure this dimension is consistent within the Rule;
- to incorporate, in the Rule, signs approved by the Director of Land Transport;
- to alter sign descriptions to accord with existing, established practice;
- to correct errors in the description of signs.
Extent of consultation
For the purposes of consultation, amendments proposed to Land Transport Rule: Traffic Control Devices 2004 and nine other Land Transport Rules were combined into a single draft Rule, Land Transport Rule: Omnibus Amendment 2007 (the Omnibus Amendment Rule).
On 3 August 2007, Land Transport New Zealand sent details of the proposed amendments by letter or email to about 2500 groups and individuals who had registered an interest in the Rules to be amended, seeking submissions. The draft Omnibus Amendment Rule was made available through the Land Transport NZ Help Desk and, together with Questions and Answers, was also available on the Land Transport NZ website. The availability of the draft for comment was publicised in the metropolitan daily newspapers in Auckland, Hamilton, Wellington, Christchurch and Dunedin and in the New Zealand Gazette. Land Transport NZ received 35 submissions on the draft Omnibus Amendment Rule, of which seven commented on the proposed amendments in this Rule.
Following consultation, the provisions in the draft Omnibus Amendment Rule were split into 10 separate amendment Rules, including this amendment Rule. The submissions that were received were taken into account in drafting this amendment Rule before it was submitted to the Minister for Transport Safety for signing.
Part 1 Rule requirements
Section 1 Application
1.1 Title
1.1(1) This Rule is Land Transport Rule: Traffic Control Devices Amendment 2007.
1.1(2) This Rule amends Land Transport Rule: Traffic Control Devices 2004.
1.2 Date when Rule comes into force
This Rule comes into force on 17 January 2008.
Section 2 Amendments relating to traffic control devices
2.1 Poles, markings and other indicators of pedestrian crossings
Paragraph 8.2(10)(b) is amended by substituting “400 mm” for “300 mm”.
Section 3 Amendments to schedules
3.1 Amendments to Schedule 1, Signs
Schedule 1 is amended:
- (a) by inserting the following paragraph after the third paragraph1:
- “· The letter ‘f’ after a colour indicates that the colour may be fluorescent.”
- (b) by inserting the items in Schedule 1 in the appropriate places;
- (c) by substituting the items in Schedule 2 for items:
- (i) R2-10, R4-7, R4-7.1, R4-9, R4-9.1, R4-11, R5-6; and
- (ii) W10-6.1, W10-6.2, W10-6.3, W17-1.3;
- (d) in the manner indicated in Schedule 3.
