Section 2 Amendments to Rule requirements
Objective of the Rule
Land Transport Rule: Passenger Service Vehicles Amendment 2014 (the amendment Rule) amends Land Transport Rule: Passenger Service Vehicles 1999 (the Passenger Service Vehicles Rule). The Passenger Service Vehicles Rule specifies the legal requirements for the design and construction of all passenger service vehicles in New Zealand.
The objective of the amendment Rule is to make changes to the Passenger Service Vehicles Rule so that:
- the description of aisle space is clarified; and
- requirements for the fitting, certification and labelling of roof-racks on light passenger service vehicles are removed.
Extent of consultation
For the purposes of consultation, amendments proposed to the Passenger Service Vehicles Rule and ten other Land Transport Rules were combined into a single Rule, Land Transport Rule: Omnibus Amendment 2014 (the Omnibus Amendment Rule). Following consultation, the provisions in the Omnibus Amendment Rule were split into eleven separate amendment Rules, including this Rule.
The NZ Transport Agency sent details of the amendment proposals by letter or email to approximately 2,400 groups and individuals who had registered an interest in the Rules to be amended. The Omnibus Amendment Rule was made available through the NZ Transport Agency’s Contact Centre and, together with Questions and Answers, was also made available on the NZ Transport Agency’s website. The availability of the amendment proposals for comment was publicised in the daily newspapers in Auckland, Hamilton, Wellington, Christchurch and Dunedin and in the New Zealand Gazette.
The NZ Transport Agency received 25 submissions on the Omnibus Amendment Rule, of which 4 commented on the proposed amendments to the Passenger Service Vehicles Rule.
The submissions received were taken into account in finalising this amendment Rule following which it was submitted to the Associate Minister of Transport for signing.
Section 1 Application
1.1 Title
This Rule is Land Transport Rule: Passenger Service Vehicles Amendment 2014.
1.2 Commencement
This Rule comes into force on 1 November 2014.
1.3 Principal rule amended
This Rule amends Land Transport Rule: Passenger Service Vehicles 1999.
Section 2 Amendments to Rule requirements
2.1 Aisle space
2.1(1) Replace clause 3.1(1) with:
- “3.1(1) Except as specified in 3.1(2), an aisle must provide unobstructed access throughout the passenger service vehicle from each seat or row of seats to any other seat, row of seats or doorway used for passenger entry and exit.”.
2.1(2) After clause 3.1(3), insert:
- “3.1(4) Aisle space does not include:
- “(a) the minimum foot room for passenger seating positions required by this Rule;
- “(b) any space which affords access solely to one seat or to one row of seats.”.
2.2 Roof-racks
2.2(1) In clause 7.3, replace the heading “Roof-racks” with “Roof-racks on heavy passenger service vehicles”.
2.2(2) In clause 7.3(1), before “passenger service vehicle” insert “heavy”.
2.2(3) Revoke clause 7.3(2).
2.2(4) Replace clause 7.3(3) with:
- “7.3(2) A roof-rack fitted to a heavy passenger service vehicle must:
- “(a) be fitted and rated as appropriate for that particular make and model of heavy passenger service vehicle; or
- “(b) be rated and certified by a vehicle inspector, and fitted in accordance with that person’s instructions.”.
2.2(5) Replace clause 7.3(4) with:
- “7.3(3) A roof-rack fitted to a heavy passenger service vehicle must have a sign or plate on the left-hand side stating:
- “(a) the purpose of the roof-rack, if other than for general baggage; and
- “(b) the maximum weight it is allowed to carry; and
- “(c) the manufacturer of the roof-rack; and
- “(d) either of the following:
- “(i) identification of the heavy passenger service vehicle to which it is fitted (make, model and registration number, or Vehicle Identification Number, or chassis number); or
- “(ii) if rated and certified either by the vehicle manufacturer or by a vehicle inspector, for a vehicle model, the plate need not identify the individual vehicle, but must identify the approval for that vehicle model.”.
