Section 1     Preliminary

1.1     Title

This Rule is Land Transport Rule: Omnibus Amendment 2015.

1.2     Scope

This Rule amends the following Land Transport Rules:

Land Transport Rule: Heavy Vehicles 2004;
Land Transport Rule: Traffic Control Devices 2004;
Land Transport Rule: Vehicle Lighting 2004.

1.3     Commencement

This Rule comes into force on 1 November 2015.

Section 2     Heavy Vehicles

2.1     Amendments to Land Transport Rule: Heavy Vehicles 2004

2.1(1)    This section amends Land Transport Rule: Heavy Vehicles 2004.

2.1(2)    In clause 1.2(4), after “4.7(2),” insert “4.7(2A),”.

2.1(3)    In clause 1.2(4), after “4.8(2),” insert “4.8(2A),”.

2.1(4)    Replace clause 4.7(2A) with:

 “4.7(2A)    Despite 4.7(2) and subject to 4.7(2B), an imported vehicle may, instead of complying with 4.7(2), have fitted as original equipment a 50 mm diameter fifth wheel that complies with UN/ECE Regulation 55: Uniform Provisions Concerning the Approval of Mechanical Coupling Components of Combinations of Vehicles E/ECE/324 Rev.1/Add.54/Rev.1 E/ECE/TRANS/505.”

2.1(5)    Replace clause 4.7(2B) with:

“4.7(2B)    A modification or repair to a 50 mm diameter fifth wheel that complies with 4.7(2A) must comply with 4.7(2)(a) or 4.7(2)(b).”.

2.1(6)   In clause 4.7(3A), replace “six months after the date on which the amendment Rule comes into force” with “29 December 2007”.

2.1(7)    Replace clause 4.8(2) with:

“4.8(2)        A 50 mm diameter kingpin and associated skid plate fitted to a vehicle must comply with:

“(a)     New Zealand Standard 5451: 1989, Coupling Devices for Articulated Vehicles — Fifth Wheel Kingpins; or
“(b)     all of the following:

“(i)       Australian/New Zealand Standard 4968.1-2003: Heavy-road vehicles – Mechanical coupling between articulated vehicle combinations – Design criteria and selection requirements for fifth wheel, kingpin and associated equipment; and
“(ii)      Australian/New Zealand Standard 4968.2-2003: Heavy-road vehicles – Mechanical coupling between articulated vehicle combinations – Testing and installation of fifth wheel and associated equipment; and
“(iii)     Australian Standard 2174-2006: Articulated Vehicles – Mechanical coupling between prime movers and semitrailers – Interchangeability requirements.”.

2.1(8)    After clause 4.8(2) insert:

“4.8(2A)     Despite 4.8(2), and subject to 4.8(2B), an imported vehicle may, instead of complying with 4.8(2), have fitted as original equipment a 50 mm diameter kingpin and associated skid plate that complies with UN/ECE Regulation 55: Uniform Provisions Concerning the Approval of Mechanical Coupling Components of Combinations of Vehicles E/ECE/324 Rev.1/Add.54/Rev.1 E/ECE/TRANS/505.

“4.8(2B)      A modification or repair to a 50 mm diameter kingpin and associated skid plate that complies with 4.8(2A) must comply with 4.8(2)(a) or 4.8(2)(b).”.

2.1(9)    In clause 4.8(3A), replace “six months after the date on which the amendment Rule comes into force” with “29 December 2007”.

2.1(10)  In clause 4.8(4A), replace “six months after the date on which the amendment Rule comes into force” with “29 December 2007”.

Section 3     Traffic Control Devices

3.1     Amendments to Land Transport Rule: Traffic Control Devices 2004

3.1(1)   This section amends Land Transport Rule: Traffic Control Devices 2004.

3.1(2)   In clause 5.2(3), after “regulatory” insert “, warning, or advisory”.

3.1(3)   Replace clause 7.7(3), with:

“7.7(3)        A road controlling authority must not install, plant or place anything that presents a hazard to road users on a raised traffic island, unless the object is protected with barriers or is frangible.”

3.1(4)    In clause 8.4(5)(d), replace “either side of the road” with “each approach to the school crossing point”.

3.1(5)    In clause 12.7, before “If a road controlling authority”, insert “12.7(1)”.

3.1(6)    After clause 12.7(1), insert:

“12.7(2)      Despite 12.4(8) and 12.7(1), the colour of the markings indicating a parking space that is reserved for ‘residents permit parking’ may be white, unless the parking space is reserved for all hours of the day and night.”

3.1(7)    In Schedule 1 Signs, replace item R1-2.1 with the item set out in Schedule 1.

3.1(8)    In Schedule 1 Signs, after item R3-5.3, insert the item set out in Schedule 2.

3.1(9)    In Schedule 1 Signs, item R3-13.3, under “Description” replace “R3-13.1 ‘keep left’” with “R3-13 ‘keep left’”.

3.1(10)    In Schedule 1 Signs, after item W2-1.23, insert the item set out in Schedule 3.

3.1(11)    In Schedule 1 Signs, after item W6-4, insert the items set out in Schedule 4.

3.1(12)    In Schedule 1 Signs, item W10-2, under:

  1. a. “Description”, replace “triangle” with “equilateral triangle”.
  2. b. “Colour” replace “red” with “white”.
  3. c. “Colour” replace “white” with “red” the first time it occurs.
  4. d. “Size” replace “310 x 310 mm” with “sides 380 mm long”.
  5. e. “Size” replace “50 mm” with “38 mm”.

3.1(13)    In Schedule 1 Signs, item W19-2.1, under “Symbol”, after “‘depiction of curve’ (as in W12-1 and W12-2 series)”, insert on a new line, “‘arrow depicting the shape of the curve’ (as in W12-1 and W12-2 series signs) with a ‘symbol of a railway line superimposed in the appropriate location’”.

[Note: an example of this new “Active LED railway crossing at curve” sign is included in Schedule 5].

3.1(14)   In Schedule 1 Signs, item W19-2.1, under “Text”, after “‘advisory speed in km/h’ (as for sign W12-3.2) or ‘SLOW DOWN’”, insert on a new line, “‘advisory speed in km/h’ (as for sign W12-3.2) or ‘SLOW DOWN’”.

3.1(15)    In Part 2 Definitions, replace the definition of “Light-rail vehicle lane”, with:

light-rail vehicle lane means a lane reserved for the use of light-rail vehicles by a marking or sign installed:

"(a) at the start of the lane (unless the light-rail vehicle lane is a continuous loop); and
"(b) at each point at which the lane resumes after an intersection.”

Section 4     Vehicle Lighting

4.1     Amendments to Land Transport Rule: Vehicle Lighting 2004

4.1(1)     This section amends Land Transport Rule: Vehicle Lighting 2004.

4.1(2)     Under “Material incorporated by reference” replace “Land Transport New Zealand” with “New Zealand Transport Agency” in both places at which it occurs.

4.1(3)    After clause 7.2(3), insert:

“7.2(4)        The light emitted from a forward-facing side-marker lamp must be diffuse light that is substantially white or amber on vehicles manufactured before 1 January 2006.

“7.2(5)        The light emitted from a forward-facing side-marker lamp must be diffuse light that is substantially amber on vehicles manufactured on or after 1 January 2006.”

4.1(4)    In clause 7.6(8), replace “exceeds 1.8 m in overall width” with “is 1.8 m or more in overall width”.

4.1(5)    In clause 7.6(9), replace “exceeds 1.8 m in overall width” with “is 1.8 m or more in overall width”.

4.1(6)    In clause 9.1(2), before “fitted to a heavy motor vehicle”, insert “that is required by the Rule or any other enactment to be”.
