An introduction to land transport rules, including the status of rules currently being developed.
The NZ Transport Agency Waka Kotahi (NZTA) and Te Manatū Waka the Ministry of Transport regularly compile, consult and make changes to packages of rule amendments. This activity was previously known as the ‘Omnibus Rule’ process.
From 2021 this Omnibus Rule process will be replaced with the Regulatory Systems (Transport) Amendment Rules (RSRA) process. The only difference between these processes is the expanded remit of RSRA. Omnibus Rule Packages were limited to more minor items such as cross-referencing errors or matters deemed ‘non-controversial’. RSRA packages will cover items of this nature as well as slightly more substantial Rule changes.
The consultation systems and processes for RSRA remain the same as for Omnibus Rules, and there is no need to re-register your interest for the Rules program with NZTA.
It is important to note Omnibus/RSRA amendment rule packages only exist as ‘Omnibus/RSRA Rules’ for consultation purposes. Once amendments are finalised, each Rule change from an Omnibus/RSRA package is split out. This creates different amendment rules for each affected principal rule.
For example, changes consulted on in an Omnibus/RSRA process impacting the Land Transport Rule: Vehicle Standards Compliance 2002 will create a Land Transport Rule: Vehicle Standards Compliance Amendment Rule. The year of such an Amendment Rule will be that of the Omnibus/RSRA the change came from, that is, there are no final ‘Omnibus/RSRA Rules’ as such.
